Knowing your rights when faced with dismissal

Dismissal, and the process leading up to it, is difficult to deal with. If you have been dismissed you may be eligible to make an unfair dismissal claim in an employment tribunal. You may also have the right to claim discrimination under the Equality Act 2010, or a breach of contract claim. Or you may not have been dismissed at all, but still, be able to challenge the way you have been treated by your employer's internal procedures.

Which? Legal can help

Discuss your situation with us over the phone with our friendly solicitors who specialise in the laws around dismissal and are experienced in resolving all kinds of issues with the process.

Common questions we can answer include:

  • In what circumstances can my employer dismiss me?
  • Should my employer follow a process before dismissal and, if so, what should this process involve?
  • Can I bring someone with me to meetings? Can this be my partner?
  • Who should deal with the investigation and/or any disciplinary hearing? Should they be independent, and, if so, how?
  • How can I challenge the employer’s evidence?
  • How do I challenge a decision to dismiss me?
  • What are my rights if I have only been employed for one year?
